Terms of Service

These Terms of Service (the "Terms") govern your access to and use of SocialTelescope (the "Service"), a social listening product operated by GX Tech Solutions LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SocialTelescope helps you monitor keywords and mentions across third-party platforms (such as X/Twitter, Reddit, Hacker News, and Product Hunt). The Service does not publish content on third-party platforms on your behalf; you remain responsible for any content you post elsewhere.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at contact@socialtelescope.com if you suspect any unauthorized use.

3. Subscriptions, billing, and Merchant of Record

Paid plans are billed on a recurring basis (monthly or yearly) until cancelled. Our payments and subscription billing are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all paid orders. By purchasing a subscription, you also agree to Paddle's terms and to receive invoices and payment-related communications from Paddle.

Subscription fees are charged in advance and are non-refundable except as set out in our Refund Policy. You can cancel your subscription at any time from your account settings; cancellation stops future renewals and your access continues until the end of the paid period.

We may change pricing or plan features. We will provide reasonable notice before any change applies to your existing subscription, typically at the start of the next billing cycle.

4. Acceptable use

You agree not to:

• Use the Service to harass, defame, or send unsolicited messages to anyone;
• Reverse engineer, scrape, or attempt to disrupt the Service or its infrastructure;
• Resell or sublicense the Service without our written permission;
• Violate any law, third-party platform terms (including those of X, Reddit, Hacker News, or Product Hunt), or other person's rights when using the Service;
• Use the Service to generate or distribute spam, malware, or content that violates AI provider use policies.

5. Third-party platforms and content

The Service surfaces public content from third-party platforms. We are not affiliated with those platforms, and they may change their APIs, rate limits, or terms in ways that affect what we can show you. You are responsible for following each platform's rules when you engage with mentions discovered through the Service.

6. Intellectual property

We retain all rights in the Service, including its software, design, and trademarks. You retain ownership of the content you provide to the Service (such as keywords, product descriptions, and drafts). You grant us a limited, worldwide license to process that content solely to operate and improve the Service for you.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect every relevant mention on a third-party platform.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue.

10. Termination

You may stop using the Service at any time and delete your account from settings. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk for us or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
